The driver whose school bus careened off Highway 410 northwest of Toronto in a crash that killed 10-year-old John Pham will not be charged because she was suffering from an undiscovered brain tumour at the time.

Dalton McGuinty will be visiting a hospice today in Hamilton and, earlier in the week, he stopped by a hospital and a school under construction in Guelph. The Ontario Premier likes doing this on the ''tour days'' that he fits into his schedule because it gives him the opportunity to talk about what his government has done for the province's health and education systems. When Mike Harris's Ontario government downloaded responsibility for social services onto municipalities a decade ago, provincial Liberal leader Dalton McGuinty planted himself firmly in the corner of cities. The province, Mr. McGuinty charged, was forcing municipal governments either to make drastic cutbacks or to impose untenable boosts to property-tax rates. Police have made another arrest in connection to an alleged rival gang shootout that claimed the life of 11-year-old Ephraim Brown.Sheldon Gladstone Evans, 22, of Toronto, was arrested yesterday by the Toronto police guns and gangs task force. He is charged with failure to comply with recognizance. Police allege Mr. Evans was present at a Sheppard Avenue birthday party early Sunday where a shootout between rival gangs broke out. Ephraim was killed when he was caught in the crossfire. After the shootout, investigators say, Mr. Evans fled the scene.

Ontario Premier Dalton McGuinty says Toronto councillors are evading their responsibilities by refusing to pass the tax measures needed to deal with the city's fiscal crisis.The Premier said yesterday that his government has done what it can to relieve the pressure on Toronto's budget and that it has recognized the city's special status within Ontario by giving it special powers to levy new taxes. But he expressed disappointment with city council's decision last week not to use those new powers to approve $350-million in new taxes that Mayor David Miller said were essential for Toronto's fiscal future.

In the CTV News footage taken from the Saturday night - early Sunday morning, actually - that Ephraim Brown was killed, there is one particularly significant bit.In several frames, six or seven tiny children, who look to be between 4 and 8, are walking down a darkened street. There are enough of them that they take up almost the entire road. They hold hands, and are being led to the safety of a city bus by uniformed Toronto police officers. At one end of the row of youngsters is a young mother carrying a baby. (Globe Insider subscribers only)
